Terms of Service

By accessing or using our services you agree to these Terms. We provide logistics, warehousing, freight forwarding and related services under mutually agreed contracts and booking confirmations. All services are subject to written confirmation by Hypeperks.

  • Bookings: subject to availability and Hypeperks' standard terms.
  • Pricing: fees, duties and taxes may apply; quotes valid as stated.
  • Third-party carriers: separate terms may apply for carriage, customs and delivery.

Consumer rights — New Zealand

For consumers in New Zealand, statutory rights under the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 apply. These rights cannot be contracted out of; they include guarantees that services will be carried out with reasonable care and skill and within a reasonable time.

If you are a consumer and believe services have not met the CGA guarantees, contact us via Contacts for remediation steps. We will respond in accordance with applicable NZ consumer protection laws.

Warehouse operations
Refunds, replacements or remedies under NZ law are handled case-by-case. Our customer service aims to resolve valid consumer claims quickly.

Liability, indemnity and limitation

To the fullest extent permitted by law, Hypeperks' liability for loss or damage arising in connection with our services is limited to the value of the particular service or as otherwise agreed in writing. Nothing in these Terms is intended to exclude or limit your statutory rights under NZ law where such exclusion would be unlawful.

We exercise reasonable care in handling goods. Loss or damage claims must be notified promptly and supported by documentation. Time limits and carrier rules may apply.

Clients indemnify Hypeperks against liabilities arising from incorrect instructions, illegal goods, or failure to disclose material facts affecting carriage or customs clearance.

We may subcontract carriage, customs brokerage, and other services. Those third parties' terms may apply and limit liability; copies are available on request.
